Probate
Probate is the court process of distributing the assets of a decedent to their heirs and beneficiaries. When there is no trust involved and the gross estate (all property held in the name of the decedent alone) at the time of death exceeds $100,000, a probate proceeding must be opened to settle the estate, whether or not there is a will for the decedent.
